ARTICLE 1: PURPOSE AND IDENTIFICATION
The following provisions constitute a contract establishing the general terms and conditions for the sale of products on the www.lingerie-pierre.com website between PIERMI SA, a legal entity, and a major consumer acting outside his professional activity, hereinafter referred to as "the customer."
ARTICLE 2: PRICES
The prices are indicated in euros, all taxes included (VAT at 21% in Belgium) excluding the shipping costs. All orders are payable in Euros. The prices take into account the VAT applicable on the day of the order. Any change in the VAT rate will be reflected automatically in prices. The products will be invoiced on the basis of the rates in effect at the time of the order, subject to availability on date of order. The company reserves the right to modify its prices at any time.
ARTICLE 3: ORDER
The customer declares to be at least 18 years old and has the legal capacity to order on the site. All orders imply the customer's complete and irrevocable acceptance of these general conditions of sale and the acceptance of prices and descriptions of products available for sale. The company reserves the right to refuse any order from a customer with whom an ongoing dispute exists.
ARTICLE 4: METHODS OF PAYMENT
At the time of the validation of the order, the customer chooses his or her method of payment: Credit Card (Visa, Mastercard) or Bank Transfer. If the credit card is settled, the customer is redirected to the Bluepaid secure server and follows the instructions. Credit card details are encrypted using Secure Socket Layer (SSL) protocol and transmitted directly to our banking partners without transitions by our servers. The order is processed upon acceptance of payment. If customer chooses the payment by bank transfer, the customer prints the transfer order to be transmitted to his bank (PDF file). The order will be sent to the customer as soon as the transfer is confirmed. In case of unpaid or rejected payment, for whatever reason, all the charges invoiced by the bank will be borne by the customer and may also give rise to a fixed penalty of 10 euros for handling fees.
ARTICLE 5: AVAILABILITY AND DELIVERY
All products on our site are normally in stock and any order made in Belgium and settled by Credit Card via Bluepaid before 12H will be shipped the same day (except bank holidays and weekends) and received by the customer 24h to 48h later. In very rare cases these periods may be increased. Orders will be prepared no later than the day following their registration, unless they have been introduced on a Friday, weekend, public holiday or on the eve of a public holiday, in which case they will be prepared the next working day, except in case of force majeure. The deadline will be 48 hours minimum and one week maximum. If, despite our vigilance, one or more items are unavailable after acceptance of the order, we will inform you by e-mail or phone as soon as possible. The customer can in this case replace the item with another or cancel his order. The refund will be made to the buyer's account within 15 days of the buyer's payment. The orders will be delivered at home by Bpost or in a relay point by Kiala. Orders will arrive in a solid, neutral packaging with no distinctive sign on the origin or content of the package. All charges, taxes, duties, fees or other benefits payable under Belgian regulations are the responsibility of the purchaser. The shipping costs are applied on a flat rate basis. The price of the delivery will be calculated on the basis of the weight of the order. The weight of each item is mentioned on the product sheet of each item in the specifications.

Packages from 0 to 15kg = 14 euros
The Company shall not be held responsible for delays due to postal strikes or other imponderables provided for by the legislation on the transport of goods and merchandise.
Finally, if he or she wishes, the customer can also choose to withdraw the order in store: Rue Haute, 6 to 1300 Wavre in Belgium. In this case, there will of course be no delivery costs.
ARTICLE 6: EXCHANGES
The customer has a period of 7 clear days from the delivery of his order to return to the Company unused products in their original sealed packaging with their accessories for exchange. No exchange of products with sealed packaging will be carried out. For hygiene reasons: panties, thongs, boxers, tights and stockings will not be exchanged. The customer must first contact Customer Service by email or telephone and then return the products by Le Poste or private carrier with assured tracking for the value of the merchandise it contains. The risks related to the return of the items (loss or deterioration), as well as the costs of return, remain the responsibility of the customer. The customer will have to attach the payment of the amount of the postage corresponding to his country of destination for the expenses of sending of the new chosen article and the possible supplement of the price of the order. Consequently, the Company undertakes to send the customer the new article selected as soon as possible. In the event of an error occurring during the processing of the order, the Company will bear all the shipping costs.
ARTICLE 7: GUARANTEE AND RETURNS
In case of defective article or malfunction, the customer has a period of 1 month from the delivery of his order to return the product to the Company. The Company then agrees to exchange or refund it to the customer, provided that it is returned to the Company in its original packaging. During a return due to default, we refund the shipping costs according to the rates in force by a bank transfer. For hygiene reasons, this warranty does not apply to panties, thongs, boxers, tights and stockings. In this context, the return costs will be borne by the Company and the exchange implemented immediately. In case of refund, it will be made by bank transfer within a period of 30 days or less following the date of receipt of the returned parcel. No consignment for cash will be accepted for any reason.
ARTICLE 8: NOMINATIVE INFORMATION
The Company undertakes not to disclose personal information to third parties. They will be exclusively operated by its internal departments. In accordance with the Personal Data Protection Act of 8 December 1992, the customer has the right to access, rectify and delete personal data concerning him or her by making the request to the Customer Service of the Company by mail or email indicating his name, first name and address.
ARTICLE 9: INTELLECTUAL PROPERTY
All texts, comments, books, illustrations and images reproduced on the documents of the Boutique PIERRE are reserved under copyright and intellectual property law. Any use other than private use without the prior written permission of the company constitutes infringement under intellectual property law. Any total or partial reproduction of the documents published by the trademark and the company is strictly prohibited.
ARTICLE 10: ENTIRE AGREEMENT
In the event that any of the present general conditions of sale were declared inapplicable, the application of the other provisions would not be called into question and an amendment would only affect the one in question.
ARTICLE 11: RESPONSIBILITIES
The photographs, graphics and texts illustrating the products are not contractual. Consequently, the company can not be held liable in case of error, omission or modification of the characteristics of the products by the supplier. The Company can not be held responsible for non-performance of the contract in case of stock shortage, product unavailability, force majeure, disruption or strike of postal services, transporters, means of transport and communication, Floods, fires, shortages, natural disasters, war, riots, insurrections, etc.
ARTICLE 12: APPLICABLE LAW AND LITIGATION
These general conditions of sale are governed by Belgian law and may be changed at any time without notice. Any dispute resolution can be made to our customer service and in the absence of a friendly settlement, it will be under the jurisdiction of the Commercial Court. However, the company reserves the right to summon the client before the Court of jurisdiction of its domicile.
